Is the Employment Rights Act 2025 in force?
The Act received Royal Assent in December 2025 and is being delivered in phases. Already in force: SSP reform and day-one paternity/unpaid parental leave (April 2026). Employer-facing duties ahead: harassment prevention 30 October 2026, dismissal changes 1 January 2027. [1][2]
What must I do about harassment?
From 30 October 2026, employers must take all reasonable steps to prevent sexual harassment of employees — including harassment by third parties such as clients and customers. Where a tribunal finds the duty was breached, compensation can be uplifted by up to 25%. [2][4][5]
What changes on dismissals?
From 1 January 2027, the unfair dismissal qualifying period drops from two years to six months, and the cap on compensation is removed. Fire-and-rehire protections also take effect in January 2027. [1][2]
What about zero-hours and low-hours workers?
Workers on zero-hours and low-hours contracts will gain the right to guaranteed hours based on a reference period of hours actually worked, plus rights to reasonable notice and short-notice payment. Regulations are expected in 2027, with timing to be confirmed after consultation. [1]
What changed with Statutory Sick Pay?
Since 6 April 2026, the Lower Earnings Limit and the three waiting days were removed from SSP — eligible employees are paid from day one of sickness. [1][3]
